These Terms of Service ("Terms") govern your access to and use of this website, operated by Pinnacle Sales Group ("Pinnacle," "we," "us," or "our") as an authorized distributor of Marvel Refrigeration products. By accessing or using this site, you agree to be bound by these Terms. If you do not agree, please do not use this site.

Pinnacle reserves the right to modify these Terms at any time. Changes take effect upon posting to this site. Your continued use after any modification constitutes your acceptance of the updated Terms.

2. Use of the Site

You agree to use this site only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the site in any way that violates applicable local, state, national, or international law or regulation.
  • Submit false, misleading, or fraudulent information through any form on this site.

All content on this site — including but not limited to text, photographs, videos, graphics, logos, brand names, product descriptions, and HTML/CSS/JavaScript code — is the property of Pinnacle Sales Group, Marvel Refrigeration, or their respective licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and download content from this site solely for your own personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content for commercial purposes without the prior written consent of Pinnacle Sales Group.

The Marvel Refrigeration brand, logo, and product names are trademarks of their respective owners. The Pinnacle Sales Group name and logo are trademarks of Pinnacle Sales Group. Nothing on this site grants you any license or right to use any trademark without the express written permission of the respective owner.

4. Form Submissions and Lead Inquiries

When you submit a form on this site — including the brochure download form or dealer locator — you represent that the information you provide is accurate and complete. By submitting a form, you understand that:

  • Your contact information may be shared with the nearest Pinnacle-authorized Marvel Refrigeration dealer so they may follow up with you directly.
  • A Pinnacle Sales Group representative may contact you to offer personalized product or dealer assistance.
  • If you have opted in to transactional communications, you may receive non-promotional service messages related to your submission.
  • If you have separately opted in to marketing communications, you may receive promotional emails about Marvel Refrigeration products and events. This is always optional and you may unsubscribe at any time.

Submitting a form does not obligate you to make any purchase, and does not create a contractual relationship between you and Pinnacle Sales Group or any authorized dealer.

5. SMS Messaging Program

By opting in to receive text messages (SMS) from Pinnacle Sales Group, you agree to the following terms:

  • Program name: Pinnacle Sales Group — Marvel Refrigeration Alerts & Updates
  • Program description: Pinnacle Sales Group uses SMS to send two types of messages to users who have explicitly opted in: (1) non-marketing transactional notifications such as submission confirmations, appointment reminders, and account updates; and (2) promotional messages about Marvel Refrigeration products, events, special offers, and service updates.
  • Opt-out: Text STOP at any time to unsubscribe from text messages. After texting STOP, you will receive a one-time confirmation and no further messages will be sent.
  • Help: Text HELP for assistance, or contact us at sales@pinnaclesalesgroup.com.
  • Message & data rates: Msg & data rates may apply. Message frequency may vary.
  • Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
  • Age restriction: By opting in to SMS communications, you confirm that you are 18 years of age or older.
  • Consent is not a condition of purchase. You are not required to opt in to SMS communications to submit a form or receive assistance from Pinnacle Sales Group.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PINNACLE SALES GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PINNACLE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINNACLE SALES GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS SITE, EVEN IF PINNACLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PINNACLE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Any dispute arising under or relating to these Terms or your use of this site shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
